DALLAS, TX — Nebraska has joined five other states in suing the Obama administration over the Affordable Care Act.
The group objected in the Northern District of Texas to the Health Insurance Providers Fee assessed to health insurers to cover federal subsidies. They say nothing in the acts language provides clear notice the states would have to pay a fee.
The suit asks for an injunction against the federal rules that say states are responsible for the fee and a refund for what’s already been paid. The fee is projected to allow the federal government to collect between $13 billion and $15 billion from states over the next decade.
Also joining in are Texas, Wisconsin, Kansas, Louisiana and Indiana.
