An inmate at the Reception and Treatment Center of the NDCS assaulted a staff member and sent them to the hospital and another staff member was injured in the incident. The NDCS report say the assault happened on Dec. 20th in the pantry office at the facility. The inmate got verbally aggressive with the staff member and stuck them in the head. The staff member then deployed a burst of oleoresin capsicum or (OC). When doing this the staff member accidently hit and injured another staff member with it. The inmate was restrained when other staff members arrived and the staff member that was injured was taken to the hospital and treated for their injuries. Both the inmate and the second staff member were treated at the facility for their exposure to the OC. NDCS will conduct an investigation into the assault and then give those findings over to the county attorney for potential criminal prosecution.
