LINCOLN — A man convicted of assaulting and kidnapping after attacks on his former wife in Custer County has had the ruling overturned.
The Nebraska Supreme Court ruled that a hearing should’ve been held on the defendant’s claim that prosecutors had seen his confidential trial strategy, violating his constitutional rights.
Tyler Bain was convicted in 2014 for the 2011 attack and sentenced to life in prison.
One of the prosecutors who handled the case told the trial court he had seen a document from the defense that discussed trial strategy. The judge determined that the prosecutor who actually tried the case hadn’t seen the document, but the high court says that wasn’t sufficient to ensure Bain’s rights weren’t violated.
